Terms of Service

1. Scope and provider
These terms apply to the use of the “Herdy Fitness” app. The provider is:

2. Services
The app creates training plans based on your goal, experience and training days, lets you record workouts and body weight, and shows your history. Use of the app is currently free of charge.
Paid subscriptions are planned for the future. They only take effect if you expressly order them; prices, term, cancellation and right of withdrawal will be set out in supplementary terms before launch.
3. Account
- An account is required. You must be at least 16 years old.
- Please provide truthful information and keep your login details secret. Let us know if you suspect misuse of your account.
- You can delete your account in the app at any time.
4. Health notice
Herdy Fitness is not a medical device and does not replace medical advice. The training plans are general recommendations and do not take pre-existing conditions or injuries into account.
Consult a doctor before starting a training programme, especially if you have health restrictions, are pregnant or have not trained for a long time. Stop an exercise immediately if you experience pain, dizziness or shortness of breath. Use proper technique and choose weights you can handle safely.
5. Permitted use
The app is intended for personal use. In particular, you may not manipulate or overload the app or its interfaces, scrape it automatically or circumvent security mechanisms.
6. Your content
The data you enter (e.g. workouts, body weight, custom exercises) remains your data. We only use it to provide the app to you. Details are set out in the Privacy Policy.
7. Availability and development
We aim for high availability but cannot rule out interruptions, for example due to maintenance or faults. We continue to develop the app and may change features where this is reasonable for you and the core of the service is preserved.
8. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.
In cases of slight negligence, we are only liable for breaches of essential contractual obligations (obligations whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely), limited to the foreseeable damage typical for the contract.
9. Termination
You can end the contract at any time by deleting your account. We may terminate the contract with four weeks’ notice; the right to terminate for good cause, for example in the event of serious breaches of these terms, remains unaffected.
10. Changes to these terms
We may change these terms if laws, case law or the app’s services change. We will notify you in the app or by email at least four weeks before the changes take effect. If you do not agree, you can delete your account before then. Changes affecting the main service or prices only take effect with your express consent.
11. Governing law and jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection provisions of the country of your habitual residence remain unaffected; this also applies to the statutory place of jurisdiction.
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
12. Language versions
These terms are available in German, English and Japanese. In case of discrepancies, the German version prevails unless mandatory law provides otherwise.
